Collaborative Law Basic Training | Collaborative practice is an alternative to any form of dispute resolution that leaves the relationship between the parties broken and the parties themselves frustrated by a loss of control over the way personal and business problems are being handled.

In collaborative practice, all parties – each represented by counsel – work in a cost- and time-effective manner to achieve a settlement that reflects the needs and interests of all, including an agreement that the collaborative lawyers will not take the matter to court themselves if the effort fails.

This concept works best when the disputing parties have an ongoing relationship with each other or with third parties that they wish to maintain.

Besides prompt and efficient resolution, other benefits include complete privacy of the proceeding with no public record, as well as allowing the parties to maintain control of the outcome – with no judge, jury or arbitrator dictating the result.

Wednesday, November 8

Transforming Impasse from Obstacle to Opportunity | The training for day two, presented by Mark Springfield and Stephen Sulmeyer, complete the basic training for those who have not had previous training, and build on the one or two-day basic collaborative law training to give participants a greater understanding of what contributes to impasse and some advanced tools for reaching settlement in difficult collaborative law cases. 

In addition to incompatible positions, impasse in negotiations can often be caused by such things as a failure to adequately address the emotional concerns of the parties; insufficient attention to the needs of the parties for greater mutual understanding of what is of primary importance to them; and reluctance of the professionals to be adequately open and vulnerable to the often unsettling aspects of the parties’ emotional needs. 

Participants learn how to distinguish and work differently with the “legal case” and the “emotional case,” how to recognize and work effectively with the parties’ sometimes subtle “emotional outcroppings,” and acquire tools for going beyond basic interest-based negotiations to get to the heart of disputes and resolve the real issues that are preventing agreement.
