One of the most sacrosanct duties for lawyers is the duty of confidentiality.

A client has a right to trust that his or her lawyer will not improperly divulge information about the representation.

This trust is one of the hallmarks of the client-lawyer relationship.

In this surprisingly funny webinar, legal humorist Sean Carter explores the contours of the rules concerning lawyer confidentiality.

Drawing on examples from his annual Ethy Awards for the worst ethical behavior, Sean Carter illustrates the ethical consequences of violating these rules.

In particular, this webinar covers:

  • The general duties of confidentiality to prospective, current and past clients
  • How and when clients can waive their right to confidentiality
  • The circumstances in which lawyers may ethically disclose client information
  • The duty to avoid even inadvertent and unauthorized disclosures
  • The consequences of breaching confidentiality

While issues of attorney-client privilege and work product may arise in this webinar, the main focus is on confidentiality as required by the ethics rules.
