In this webinar, Professor Mark Yochum parses ABA Model Rules 1.7(a) and 1.8(j).

In doing so, he attempts to answer for the ultimate issue faced by lawyers who find themselves developing romantic feelings for a client -- when does the lawyer’s love interest create a “significant risk” of a material limitation on the relationship?

And while the answering this hypothetical question deals with a special corner of evil, it provides instruction about the larger issue of conflicts of interests embodied in Rules 1.7, 1.8, 1.9 and 1.18.

And therefore, while very few lawyers will ever deal with this particular conflict (hopefully), it can serve as a memorable vehicle to remind lawyers of the less salacious (but no less damaging) conflicts of interest that ensnare many lawyers.
