Developing Issues in Post Grant Patent Challenges

In this session, the speaker discusses several topics of developing interest in post grant challenges before the Patent Trial and Appeals Board (PTAB).

The session begins with an overview of Inter Partes Review (IPR) and Post Grant Review (PGR) proceedings and then discusses changes and trends in motion to amend practice, as well as the recent Supreme Court decisions, Oil States Energy Services, LLC v. Green’s Energy Group, LLC and SAS Institute Inc. v. Iancu.

Also discussed are recent issues in IPR/PGR practice such as claim construction, indefiniteness, proposed USPTO regulations and the STRONGER Patents Act.
