Real estate transactional lawyers frequently prepare construction contracts for their owner clients. Construction law, however, is a field unto itself, laden with traps for the unwary.
This session describes disputes common to construction projects (delays, changes in scope, defective work and liens), offers a framework for owners to select from among four dispute resolution options (litigation, arbitration, dispute review board and hybrids), and illustrates owner-friendly revisions to industry form owner-contractor and owner-designer agreements (using the AIA A101, A102, A201 and B101 forms for discussion purposes).
